TERMS OF SALE

1) Basic provisions

These Terms of Sale govern the general business conditions of the online store managed by Luxoria Moissanite (hereinafter: "Seller"). Certain business areas are additionally explained in thematic sections, which you can access by clicking on the desired area. These conditions define the activity of the online store, the rights and obligations of the user, as well as the relationship between the Seller and the consumer.

The online store is an information system intended for the presentation and sale of products to consumers. A user is any person who uses the specified system, and a "consumer" is a user who buys in an online store.


2) Orders

Products can be ordered:

One order for cash on delivery payments can include a maximum of 2 items .

One order for advance payments by payment cards can include a maximum of 5 items .

All orders are subject to stock availability. In case the product is not available, the customer will be informed as soon as possible.

The seller reserves the right to reject the order in whole or in part, as well as to request an advance payment, if he determines that the potential buyer's creditworthiness is impaired.


3) Delivery of goods

Delivery is made exclusively to addresses within the Republic of Serbia. The seller will make a reasonable effort to deliver the products to the address specified in the order, within three (3) working days , with standard delivery of RSD 480.00 .

After confirmation, the order goes into processing to check the availability of the items (usually 1 working day ). If the order contains several items, it is possible to send it in several packages, several days apart.

The delivery is made by the contracted courier service to the address specified in the order, on the territory of the Republic of Serbia.

If due to special circumstances or force majeure the stipulated deadline is not feasible, the customer will be informed in a timely manner. An extension may occur if the recipient is not at the address when delivery is attempted, does not respond to the number left, or due to unforeseen circumstances in transport.

The buyer is obliged to inspect the shipment immediately upon receipt and report any irregularities to the e-mail: [luxoria.moissanite@gmail.com] within 24 hours at the latest.

Ownership and risk pass to the customer upon receipt of the product.


4) Return of goods

4.1 The consumer has the right to return goods that do not suit him within 14 days from the day of receipt of delivery - in the manner described HERE .

4.2 The consumer is obliged to check the quantity and quality when taking over, and to notify the seller without delay about defective or inappropriate goods. If the product is truly defective, the Seller will repair, replace or refund it, in accordance with the law and the procedure defined here .


5) Refund - procedure

Contact us at [luxoria.moissanite@gmail.com] and submit: invoice/shipping number and dinar current account number.

Upon receipt of the data, documentation and instructions are created, which we send to the e-mail specified when ordering.

Refunds are made exclusively by payment to a dinar current account; it is not possible to return cash via courier.

The return costs are borne by the buyer.


6) Complaints and shipment receipt

We recommend checking the package in the presence of the courier. If the packaging is visibly damaged (torn, dented), the package should not be picked up . You will be informed about further steps without delay.

If, after opening, you find that the goods do not correspond to what was ordered or that the information on the invoice is incorrect, contact us at the latest within 24 hours of receiving the shipment at [luxoria.moissanite@gmail.com] .

The seller is responsible for the non-conformity of the delivered goods with the contract, in accordance with the Law on Consumer Protection. A consumer is a natural person who buys outside of his business activity.

If the goods do not conform to the manufacturer's specification, the consumer may request: elimination of the nonconformity by repair or replacement , and then a proportional reduction in price or termination of the contract (if repair/replacement is not possible or would represent a disproportionate burden).

Repair or replacement is carried out within 15 days , or 30 days for technical goods from the day of receipt of the complaint (the deadline can be extended in accordance with Article 56 of the Civil Code), without significant inconvenience for the consumer, taking into account the nature of the goods and the purpose of the purchase. All necessary costs (labor, material, collection/delivery) are borne by the Seller .

The consumer may terminate the contract if he cannot exercise the right to repair or replacement, or if they are not performed within the deadline, or are not performed without significant inconvenience. Termination is not possible if the inconsistency is slight .

The Seller's liability for non-conformity lasts for 2 years from the transfer of risk to the consumer (from the date of the fiscal invoice). If non-conformity occurs within 6 months , the consumer can choose replacement, price reduction or termination; repair is possible with the express consent of the consumer. After the expiration of 6 months, the existence of non-conformity at the time of transfer of risk is proved by the consumer.

The lack of original packaging cannot be a condition for resolving the complaint or a reason for refusing to remove the non-conformity.

The seller is obliged to respond to the complaint in writing or electronically without delay, and within 8 days at the latest, with a statement, a proposed solution and a deadline for implementation. The solution is possible only with the prior consent of the consumer.

Upon receiving consent, the Seller acts within the specified period. Untimely giving of consent by the buyer is considered an objective reason for which the Seller is unable to comply with the request within the legal term.

If, for objective reasons, the Seller cannot resolve the complaint within the agreed time limit, he will inform the customer about the extension of the time limit and ask for his consent; extension is possible only once .

If the buyer does not accept the exchange for the corresponding item, the purchase price will be refunded.

7) Prices and payment methods

All prices are expressed in RSD and include VAT. The price does not include shipping costs. Seller may change prices without prior notice, but not after confirmation of your order.

You pay the price valid at the time of sending the order (in RSD).

Payment methods:

  • cash on delivery;

  • payment card during online shopping – the card must be approved for online payments.

When entering card data, SSL/PKI encryption is used. Transactions are processed by an authorized payment processor (eg WSPay ); card data are not available to the Seller's system.

Payment is possible only with RSD cards of domestic and foreign banks. The debit amount is converted according to the NBS exchange rate and the exchange rate of card operators; minor deviations from the displayed price may occur due to conversions.

Payment by bank transfer (legal entities): after the order, we send instructions/proforma invoice; upon payment, the order is delivered.

We respect the right to privacy and apply procedures to ensure responsible processing of personal data. Definitions (abbreviated):
"Personal data" is information relating to an identified or identifiable natural person. "Processing" includes any action on personal data (collection, storage, use, disclosure, deletion, etc.).

3) What data do we collect?

We do not collect sensitive data. To process the order, we need: first and last name, address, city, e-mail and telephone. We use data primarily to process requests and orders; we occasionally send a newsletter to the primary e-mail (with the option to unsubscribe). Only authorized employees can access the data.

3.1. Data through interaction (cookies, analytics)

In order to optimize the site, we may automatically collect technical data (IP, date/time, referring URL, pages visited, browser type/OS). We use cookies according to our Cookie Policy .

4) Data Disclosure

We share data carefully and confidentially. When required by law or necessary to provide the service (eg delivery, payment processing, hosting, analytics, verifications), data may be shared with third parties. We may also share information for fraud protection and credit risk reduction. Providing data is voluntary, but without certain data some services will not be available. You can manage your data through a user account on the site.

  • Correction/deletion/blocking of data (on request by e-mail).

  • Restriction of processing in special circumstances.

  • Portability of data in a structured, machine-readable format.

  • Object to processing based on legitimate interest (eg marketing) and unsubscribe from marketing communications (via link in e-mail or request).

  • Withdrawal of consent at any time (does not affect the legality of previous processing).
